Appointing an AR is mandatory for producers under the new European regulations, which require all foreign producers to comply. The term "foreign" does not necessarily mean outside the EU, it refers to any producer located outside the national territory of an individual European country. For example, a Dutch producer reporting in Germany is considered foreign. This means producers must appoint an AR separately for each European country where they have obligations.
The main reason for appointing an AR is that a local representative must be present in every country where registration or compliance activities take place. Unfortunately, the EU does not provide a unified European solution for AR services. This places an additional burden on foreign producers who must comply with requirements in each country individually. European manufacturers producing goods within the EU, however, can appoint a single European AR.
