USA Expands EPR Legislation Across Multiple Waste Streams

Just like in the European Union, the United States is seeing growing momentum around Extended Producer Responsibility (EPR). Across the country, several states are actively introducing new rules, particularly for batteries, packaging, and in some cases even textiles.

For example, California is currently one of the most progressive states when it comes to EPR. It already has legislation in place for e-waste, packaging, and batteries, and is now working on regulation for textile waste as well. Other states, such as Washington, New York, Oregon and Nebraska are also progressing fast, each at their own pace and scope.

Where do things stand?

  • Oregon is expected to introduce battery EPR legislation in 2025 and already has packaging EPR rules in place.
  • Washington has active EPR for packaging and textiles, while battery legislation is under consultation.
  • California already has active legislation for batteries and packaging; textile EPR is being developed.
  • New York is working on future obligations for batteries and packaging.
  • Nebraska already has an active battery EPR whilst packaging EPR in development.

    While these legal developments are advancing quickly, most EPR programs will take effect in 2026, 2027 or 2028. This means there is no immediate reporting obligation, but producer registration is required in many states marking the official acknowledgment of responsibility.
