Packaging producers
Under the new ordinance all producers will bear obligations for the packaging placed on the market and will have to register with the local environmental agency, Naturvårdsverkets. In addition, all producers are obligated to register with a local packaging compliance scheme. Due to the fact that the ordinance does not establish a threshold, all entities placing packaging on the market are to bear the obligations.
While the requirement was already present under the previous packaging ordinance for local entities, the obligation has extended to foreign producers who, by means of distance selling directly to end-users, place packaging on the market.
Distance sellers
The distance sellers are obligated to register with Naturvårdsverkets before January 1, 2023, and will have to be registered with a compliance scheme no later the October 31, 2023. It is mandatory for foreign producers to appoint an authorized representative in order to comply with the set regulations.
