With the publishing of ‘Royal Degree on Packaging and Packaging waste – 1055/2022’, which came into effect on December 29th of 2022, the packaging obligations in Spain are extended. Where it used to be domestic packaging only, commercial and industrial packaging are now included in the Extended Producer Responsibility.

Producer obligations

Under the Royal Degree, all producers of commercial and/or industrial packaging are to register with the local authority, called the Register of the Producer of Products. To add to that, producers are to register with a local compliance scheme. It is possible to comply individually, however it is not recommended due to the list of additional requirements.

Visible fee

In addition, all producers are to comply to new requirements, such as packaging labelling and invoice requirements. According to the Royal Degree, all packaging producers are to state the registration number generated by the Register of the Producer of Products on all invoices to B2B or B2C end-users. Producers who are collectively compliant are to implement the packaging visible fee per packaging item on all consumer invoices.
