*Update February 10th 2023: The Polish Ministry of Finance plans to extend the date of entry into force of the mandatory e-Invoicing system. The obligation to issue electronic invoices will come into effect on the 1st of July 2024 instead of the 1st of January 2024. We understand this delay follows requests from taxpayers and service providers who need more time to prepare.
The document has not been yet formally published in the Official Journal of the EU, so it has no binding status and will be discussed by Ecofin (the EU Economic and Financial Affairs Council). However, we do not expect any changes. According to the document, the consent to introduce mandatory KSeF should apply as from January 1, 2024 at the earliest.
KSeF is to be limited to entities with registered seat (Polish version) / established (English version) in Poland. This means that the mandatory KSeF in Poland will not apply to non-resident businesses.
