UPDATE - New definition Ex Works announced!

The Incoterms® delivery conditions are revised by Customs every 10 years. These new incoterms will be introduced in 2020. In the past it often happened that the customer (outside the EU) who purchases in the Netherlands was responsible for the export declaration. This is now going to change.

For example: a Dutch company sells goods to a buyer in the United States of America (USA). Subsequently, the buyer picks up the goods and transports them to its company in the USA. The responsibility for the export declaration in this case always lies with the US buyer.

From October 1, 2020 onwards, this will change. The exporter must always be established in the EU, so the US buyer can no longer act as an exporter. This makes the company that exports outside the EU responsible for arranging the export declaration. In short: the US buyer is no longer in the picture at Customs and another exporter must be stated on the export declaration. For example the Dutch seller, the forwarder or even the transporter.
